Terms and Conditions
These Terms constitute a legally binding contract (“Agreement”) between you and Groupet (as defined below) that governs your access to and use of the Groupet website. Hereinafter, the Website, as well as any other websites through which Groupet makes its services (collectively known as the “Website”). Our applications for mobile phones, tablets and other smart devices and other services available that may be offered by Groupet will be referred to collectively as the “Groupet Platform”. When these Terms use “Groupet”, “we”, (and other variations included), they refer to the ownership of the website with address at C/Barcelona, 51, 08773 Mediona (Barcelona).
Our collection and use of personal information in connection with your access to use of the Groupet Platform is described in our Privacy Policy.
Organizers will be solely responsible for identifying, understanding and complying with all laws, rules and regulations that apply to their Ads and Services. For example, some activities that are organized in certain places may have laws that restrict their ability to organize activities with pets and that the Organizer must know and act accordingly. Also, Organizers may need to register, obtain permits or obtain licenses to organize an activity before they can provide Organizer services. The Organizers will be solely responsible for identifying and obtaining any licenses, permits or registrations necessary for any Activity they offer. It is possible that certain types of Organizer Services are completely prohibited and the Organizer will be responsible for the penalties that may be incurred for not complying with the laws, rules, regulations and obligations that correspond to it.
1. Scope of the Groupet Services
1.1 The Groupet Platform is a platform that allows users who offer services (hereinafter “Organizers”) that can be contracted by users interested in those services (hereinafter “Members”). The Groupet platform allows the Organizers to publish said services on the Groupet Platform and to communicate and manage directly with the Members who wish to contract said Services. The Services that the organizers can publish and manage include, activities of one or several days in various categories, access to unique places, as well as a whole range of other related services.
1.2 As a provider of the Groupet Platform, Groupet does not own, create, sell, resell, supply, control, manage, offer, deliver or render any Ads or Services from any Organizer. Organizers are solely responsible for their Advertisements and Organizer Services. When Members perform or accept a service from the organizer, they enter into a contract directly with each other. Groupet is not and will not become a party to or a participant in any contractual relationship between members and organizers. Nor does Groupet act as an agent in any capacity for any Member, except as provided in the Payment Terms.
1.3 Although we can help facilitate dispute resolution, Groupet has no control over, nor does it guarantee:
1.- the existence, quality, security, suitability or legality of any Advertisement or Service of the Organizer.
2.- the veracity or accuracy of the descriptions of any Ad.
3.- the performance or conduct of any Member or Organizer. Groupet does not endorse any Member, Advertisement or Organizer.
You should always exercise due diligence and care when deciding whether to participate in an activity or engage the services of the Organizer or communicate and interact with other Members, either online or in person. The Images that can be uploaded to the platform and that are used to advertise an Activity are only intended to indicate a photographic representation of the activity at the time the photograph was taken, and do not, therefore, represent an endorsement by part of Groupet regarding the Organizer or any announcement.
1.4 If you decide to use the Groupet Platform as an Organizer, your relationship with Groupet will be limited to that of an independent third party contractor and not that of an employee, agent, co-member in a joint venture or partner of Groupet. Furthermore, you will act exclusively in your own name and interest, and not in the name or interest of Groupet. Groupet will not direct or control, nor will it be deemed to direct or control, the actions that you take or your behavior within the framework of these Terms, including with regard to your provision of the Organizer Services. You acknowledge that you may, in your sole discretion, advertise Organizer Services or engage in any other business or employment activity.
1.5 To promote the Groupet Platform and increase its exposure to potential customers, the Ads and other Member Content may be displayed on other websites, in applications, in emails and in online and non-online advertising.
1.6 The Groupet Platform may contain links to third party websites or resources (“Third Party Services”). Such Third Party Services may be subject to different terms and conditions and different privacy practices. Groupet is not responsible for the availability or accuracy of such Third Party Services, nor is it responsible for the content, products or services available from such Third Party Services. Links to said Third Party Services do not constitute an endorsement thereof by Groupet.
1.7 Groupet is not responsible for electrical interruptions or interruptions of the Internet service or of the telecommunications infrastructure that are beyond its control and that may generate interruptions in the availability of the Groupet Platform. Groupet may temporarily restrict the availability of the Groupet Platform or certain areas or functions of the same if necessary due to capacity limits, the security or the integrity of our servers, or to carry out measures maintenance to ensure correct or improved operation. Groupet may improve, strengthen and modify the Groupet Platform, as well as introduce new Groupet Services from time to time. Groupet will notify Members of any changes to the Groupet Platform, unless these changes are minor and do not have a material effect on the contractual obligations of the parties.
2. Eligibility, Use of the Groupet Platform, Member Verification
2.1 To be able to access and use the Groupet Platform or register a Groupet Account, you must be 18 years old or older or have a company, organization, or other constituted legal entity that complies with the laws of the country in which it is established and has the legal capacity and authority to sign a contract.
2.2 Groupet may subject access and use of the Groupet Platform, or of certain areas or functions thereof, to certain conditions or requirements, such as carrying out a verification process, meeting specific qualities or eligibility criteria, satisfying Assessment thresholds or Evaluations.
2.3 Verification of users on the Internet is difficult and we do not assume any responsibility for the confirmation of identity of any Member. Notwithstanding the foregoing, for the purposes of transparency and fraud prevention, and to the extent permitted by law, we may, without being obliged to do
1.- request Members and Organizers to provide a form of legal identification such as identity card, circulation permit or passport among other information or to undergo additional checks designed to help verify the identity of Members
2.- request the criminal record.
2.4 Access to and use of certain areas and features of the Groupet Platform may be subject to separate policies, rules or guidelines, or may require you to agree to additional terms and conditions before you can access those important areas or features of the Platform. of Groupet.
2.5 If you access or download the Application from the Apple or Google Application Store, you are accepting the End User License Agreement for the application under license .
3. Modification of these Terms
Groupet reserves the right to modify these Terms at any time in accordance with this disposition. Likewise, in the case of modification, Members and Organizers will be notified of the modifications made by sending an email, at least thirty (30) days before they come into effect. If you disagree with the modified Terms, you may terminate this Agreement with immediate effect. If you do not terminate your Agreement prior to the effective date of the revised Terms, your continued access to or use of the Platform will constitute acceptance of the revised Terms.
4. Account registration
4.1 You must register an account (“Groupet Account”) to access and use certain functions of the Groupet Platform, such as posting or reserving an Ad. If you register a Groupet Account for a company, organization or other legal person, you must declare and guarantee that you have the power to legally bind said entity and grant us all the permits and licenses provided in these Terms.
4.2 You can register a Groupet Account with an email address and creating a password.
4.3 You must provide accurate, current and complete information during the registration process and keep the information on the Groupet Account and the public profile page of your Groupet Account up to date at all times.
4.4 You may not register more than one (1) Groupet Account unless authorized by Groupet. You may not assign or otherwise transfer your Groupet Account to another party.
4.5 You will be responsible for maintaining the confidentiality and security of your Groupet Account credentials and may not disclose them to any third party. You must immediately inform Groupet if you become aware or have reason to suspect that your credentials have been stolen, lost, misappropriated or threatened in any way, or in the event of unauthorized use of your Groupet Account or suspicion of it. You will be responsible for any and all activities developed through your Groupet Account, unless such activities have not been authorized by you and you have not acted negligently (such as in the event of not having reported the unauthorized use or loss of your credentials).
4.6 Groupet may activate functions that allow you to authorize other Members or certain third parties to perform certain actions that affect your Groupet Account. These functions do not require you to share your credentials with anyone. Groupet does not authorize any third party to request your credentials and you should not request the credentials of other Members.
5. Content
5.1 Groupet may allow Members to;
1.- create, upload, publish, send, receive and store content, such as text, photos, audio, video and other material and information through the Groupet Platform (“Member Content”);
2.- access and view of the Member’s Content and any content that Groupet itself makes available on or through the Groupet Platform, including content owned by Groupet.
5.2 The Groupet Platform, the Groupet Content and the Member Content may be, in whole or in part, protected by copyright, trademark and other European and foreign laws. You acknowledge and agree that the Groupet Platform and the Groupet Content, including all associated intellectual property rights, are the exclusive property of Groupet and/or its licensors or third party licensors. You will not remove, alter, or conceal any copyright, trademark or service mark or signal, or other proprietary rights notices that are embedded in or accompanying the Groupet Platform, the Groupet Content, or the Member Content. All Groupet trademarks, service marks, logos, trade names and any other source identifier used in, or in connection with, the Groupet Platform and the Groupet Content, constitute trademarks or registered trademarks of Groupet in Europe and United Kingdom. Trademarks, service marks, logos, trade names and any other denominations owned by third parties, used in, or in relation to, the Groupet Platform, the Groupet Content and / or the Collective Content, are used for identification purposes only and may be the property of their respective owners.
5.3 Groupet will not use, copy, adapt, modify, prepare derivative works, distribute, license, sell, transfer, publicly display, publicly perform, transmit, disseminate or otherwise exploit the Groupet Platform or the Collective Content, except to the extent where you are the legal owner of certain Member Content or as expressly permitted in these Terms. No license or right will be granted to you, implicitly or explicitly, by virtue of any intellectual property right owned or controlled by Groupet, with the exception of the licenses and rights that are expressly granted in these Conditions.
5.4 Notwithstanding your compliance with these Terms, Groupet grants you a limited, non-exclusive, non-sublicensable, revocable and non-transferable license for
1.- download and use the Application on your personal device(s)
2.- access and view any Collective Content made available on or through the Groupet Platform and accessible to you, solely for your personal and non-commercial use.
5.5 By uploading, posting or otherwise making any Member Content available on or through the Groupet Platform, you grant Groupet by creating, editing or making it public, a non-exclusive, international, royalty-free, sublicensable license and transferable on said Member Content for the entire period of protection of the rights granted to access, use, store, copy, modify, prepare derivative works, distribute, publish, transmit, stream, disseminate and exploit in any other way and such Member Content to provide and/or promote the Groupet Platform on any support or platform, and specifically on the Internet and social networks. As long as the Member’s content (including Verified Images) includes personal information, such content will only be used for those purposes if it complies with applicable data protection laws. Unless you give specific consent, Groupet does not claim any ownership rights in any Member Content and nothing in these Terms will be deemed to restrict any rights that may assist you in the use or exploitation of your Member Content.
5.6 You are solely responsible for all Member Content that you make available on or through the Groupet Platform. Accordingly, you represent and warrant that:
1.- You are the sole and exclusive owner of all Member Content that you make available on or through the Groupet Platform or that you have all the rights, licenses, consents and disclaimers necessary to grant Groupet the rights in and on such Member Content, as contemplated in these Terms;
2.- Neither the Member’s Content nor its publication, upload, dissemination, sending or transmission of the Member’s Content nor the use by Groupet of the Member’s Content (or any part thereof) as contemplated in these Terms will violate, will mean an improper appropriation or infringe the patent rights, copyrights, trademark, trade secret, moral rights or other private or intellectual property rights of a third party, nor the rights of privacy or protection of the personality of third parties, nor will it result in the breach of any applicable laws or regulations.
5.7 You will not post, upload, broadcast, post or transmit any Member Content that:
1.- is fraudulent, false, misleading (directly or by omission or failure to update the information) or false;
2.- is defamatory, libelous, obscene, pornographic, vulgar or offensive;
3.- promote discrimination, intolerance, racism, hatred, harassment or harm against any person or group;
4.-is violent or threatening or encourages violence or actions that are threatening to any other person or animal;
5.- promote illegal or harmful activities or substances;
5.8.- Groupet may, withdraw or deactivate access to any Content of the Member that violates the applicable laws, these Terms, or that in any way may be harmful or offensive to Groupet, its Members, third parties or material goods. When Groupet removes or disables Content from the Member, Groupet will notify the Member and provide the reasons for such action, unless the notification
1.- make it impossible or impede the detection or impediment of fraud or other illegal activities,
2.- damages the legitimate interests of the Members or third parties,
3.- contradict applicable laws.
5.9 Groupet respects copyright law and expects its Members to do the same. If you believe that any content on the Groupet Platform infringes your copyright, please notify us.
6. Service Fees
6.1 Groupet may charge fees to the Organizers (“Organizer Fees”) and / or Members (“Member Fees”) (hereinafter, jointly, the “Service Fees”) in exchange for the use of the Groupet Platform. . (You can consult more information about when the Service Rates apply.)
6.2 Groupet reserves the right to change the Service Fees at any time, and we will notify Members of any rate changes before they take effect. Changes in this rate will not affect reservations made prior to the date of the rate change.
6.3 You are responsible for paying any Service Fees you owe to Groupet. Applicable Service Fees (including any applicable Taxes) are charged by (name of external charging platform). Unless otherwise provided in the Groupet Platform, the Service Fees are non-refundable.
7. Specific Terms for Organizers
7.1 Terms applicable to all Ads
7.1.1 When creating an Ad through the Groupet Platform you must
1.- provide complete and accurate information about your Activity (such as the description of the advertisement, the location and the availability of dates)
2.- disclose any deficiencies, restrictions and requirements that may be relevant (such as a minimum age, aptitudes or physical fitness requirements for an Activity)
3.- provide any other pertinent information that Groupet requests. You are responsible for keeping your Ad information updated at all times (including the availability of dates).
7.1.2 You are solely responsible for setting a price (including Taxes, if applicable, or extra charges) in your Activity Ad (“Ad Fee”). Once a Member requests a reservation of their Listing, they may not require the Member to pay a higher price than in the reservation request.
7.1.3 The terms and conditions included in your Ad, in particular in relation to cancellations, must not conflict with these Terms or with the cancellation policy that applies to your Ad.
7.1.4 The images, animations or videos (hereinafter, collectively, the “Images”) used in your Ads must accurately reflect the quality and condition of your Organizer Services. Groupet reserves the right to require that the Ads have a minimum number of Images of a certain format, size and resolution.
7.1.5 The placement and ranking of Ads in search results within the Groupet Platform may vary and is dependent on various factors, such as search parameters, Member preferences, Organizer requirements, price and availability of dates, the number and quality of the Images, cancellations, Comments and Ratings, the type of Activity and the ease of booking. In our Help Center , you can find more information about the factors that determine how your ad appears in search results.
7.1.6 When you accept or have previously approved a reservation request by a Member, you will be entering into a legally binding contract with the latter, which obliges you to provide your Activity to the Member as described in your Ad once the reservation process is completed. You also agree to pay the applicable Organizer Fee and applicable Taxes.
7.1.7 Groupet recommends that the Organizers take out adequate insurance for their Activities and request all the permits and authorizations they need to carry out the Activity, excluding all responsibility on Groupet in the event that an Organizer does not obtain insurance and / or pertinent permits to carry out the activity.
7. 1. 8 The organizer will ensure the safety of the companion animals, both in the organizational and planning aspects of the Activity as well as during the development of the Activity.
7.2 Co-organizers
7.2.1 Groupet may allow Organizers to work together with Organizers other than themselves to generate a Co-Organized Activity. These Co-Organizers may carry out certain actions in relation to the activity or the Ads as permitted by the Main Organizer, such as accepting reservation requests, sending messages and welcoming Members, or updating the Ad Fee and the availability of dates (hereinafter, jointly, the “Co-Organizer Services”). No contract entered into between the Organizer and the Co-Organizer may conflict with these Terms, the Payment Terms or any of the Policies that apply to your Organizer Service (s). The Co-Organizers may only act in their personal capacity and not on behalf of a company or organization, unless expressly authorized by Groupet. Groupet reserves the right, in its sole discretion, to limit the number of Co-Organizers that an Organizer can invite for each Ad and to limit the number of Ads that a Co-Organizer can manage.
7.2.2 Organizers must apply due diligence and care when deciding which person to add to their Ad(s) as Co-Organizer. Main Organizers are responsible for any and all Ads and Member Content posted on the Groupet Platform, created by a Co-Organizer on their behalf. In addition, the Main Organizers will continue to be responsible for their own acts and omissions, including, without limitation, behavior that causes damage or harm the Co-Organizers. The Co-Organizers will continue to be responsible for their own acts and omissions when they assume functions and responsibilities as Co-Organizer, including, without limitation, behavior that causes damage or harm to the Main Organizer. Additionally, both the Organizer and the Co-Organizer are jointly responsible and must respond individually to claims from third parties, including claims from Members, arising from the acts and omissions of the other person as related to the activities of reception, communications with Members and the provision of any Co-Organizer Services.
7.2.3 Unless otherwise agreed between the Organizer and the Co-Organizer, both may terminate the Co-Organizer contract at any time. In addition, both the Organizer and the Co-Organizer acknowledge that their Co-Organizer relationship will terminate in the event that Groupet 1.- ends the Co-Organizer service or 2.- ends the participation of any of the parties in the Co-Organizer service. Once the Co-Organizer contract is terminated, the main Organizer will continue to be responsible for all the actions of the Co-Organizer prior to termination, including the responsibility of satisfying any reservations of pending or future activities that had started before termination, except in the case of bad serious conduct or malicious behavior on the part of the Co-Organizer. When an Organizer is terminated as a Co-Organizer, such Organizer will no longer have access to any Organizer or Member information related to the corresponding Announcement(s) from that Organizer.
7.2.4 As a Co-Organizer, Members will not comment on you, meaning that Co-Organizer’s activities will not affect your Comments or Ratings for other Ads where you are an Organizer. Instead, the Organizer of such Announcement(s) will be subject to comments from Members (including the possibility that they may be based on the behavior and performance of the Co-Organizer). The Organizers acknowledge that Member Comments and Evaluations in their Announcement (s) may be affected by the behavior and performance of a Co-Organizer.
8. Specific Terms for Members
8.1 Terms applicable to all reservations
8.1.1 Notwithstanding compliance with all the requirements established by Groupet and / or the Organizer, you can reserve an Activity available on the Groupet Platform by following the corresponding reservation process. Before reserving an Activity, you will be presented with all applicable fees, including the Ad Fee, the Member Fee, and any applicable Taxes. You agree to pay the full amount of all fees, for the reservations requested in connection with your Groupet Account.
8.1.2 After Groupet receives a booking confirmation for an Activity, a legally binding contract is formed between you and your Organizer, which includes the corresponding cancellation policy, the treatment policy and any rules and restrictions indicated in the Announcement. After that, Groupet will charge the total fees due at the time of the reservation request or after confirmation by the Organizer.
8.1.3 If you reserve an Activity on behalf of additional or minor Members, you must do so through the section enabled in the Groupet Platform and you will be obliged to ensure that each of said additional Members meets the requirements established by the Organizer and that is aware of and accepts these Terms, as well as the terms and conditions, rules and restrictions indicated by the Organizer. If you reserve an Activity for an additional Member who is a minor you represent, you could be required to warrant that you are legally authorized to act on behalf of the minor. Minors can only participate in an Activity, if they are accompanied by an adult who is responsible for them.
8.1.4 If you reserve an Activity and want the activity to also be carried out by your pet, you must register it through the section enabled in the Groupet Platform and you will be obliged to ensure that each pet meets the requirements established by the Organizer. In addition, in the event that you register a companion animal in the activity, you declare and guarantee that said animal is legally yours or that it has the legal authorization of the relevant owner. Pets can only participate in an Activity, if they are accompanied by a Member or Organizer who is responsible for them.
8.1.5 You may, at your sole discretion, inform the Organizer of any medical or physical problem and other circumstances that may affect your ability, or that of any additional Member, to participate in an Activity and other Services that an Organizer may offer.
8.3.2 Before and during an Activity, and other Organizer Services, you must at all times respect the Organizers’ instructions.
8.3.3 You cannot bring any additional person or animal to the Activity, or other Organizer Services, unless you have added said person as an additional Member during the reservation process on the Groupet Platform.
9. Modifications, cancellations and refunds of reservations, Resolution Center
9.1 Organizers and Members are responsible for how many modifications they make to a reservation through the Groupet Platform or that they order modifications to reservations from Groupet’s customer service, and agree to pay any Ad Fees, Organizer Fees or Member Fees. Additional and Taxes are associated with said Modifications of Reservations.
9.2 Members may cancel a confirmed reservation at any time in accordance with the cancellation policy established by the Organizer, and Groupet will refund the Total Fees due to the Member in accordance with said cancellation policy. Unless there are forces of greater cause, Groupet will remit to the Organizer any parts of the Total Fees that are owed to the Organizer by virtue of the applicable cancellation policy in accordance with the Payment Terms .
9.3 If an Organizer cancels a confirmed reservation, the Member will receive a full refund of the Total Fees corresponding to said reservation. In some situations, Groupet may allow the Member to apply the refund to a new reservation, in which case Groupet will disburse the amount for the subsequent reservation of the Member at the request of the Member. Likewise, Groupet may publish an automatic comment in the Ad canceled by the Organizer indicating that a reservation has been canceled. In addition, Groupet may 1.- keep the dates of the canceled reservation blocked or unavailable for future activites, and / or 2.- impose a cancellation fee, unless the Organizer has a valid reason to cancel the reservation or lodge legitimate suspicions regarding to the behavior of the Member.
9.4 If the weather poses a risk to the safety of the Members, or if it prevents an Organizer from carrying out an Activity, the Organizers may cancel the Activity. They may also cancel it if there are other conditions that could prevent the Organizer from offering the Activity safely.
9.5 In certain circumstances, Groupet may cancel a pending or confirmed reservation on behalf of the Organizer or Member and initiate the corresponding refund. This may occur for reasons of major cause or if Groupet detects any Prohibited Activity. When Groupet cancels a reservation, Groupet will notify the Member and offer the reasons for such action, unless the notification 1.- makes it impossible or prevents the detection or impediment of fraud or other illegal activities, 2.- damages the legitimate interests of the Members or third parties, or 3.- contradict applicable laws. You can appeal this decision by contacting Customer Service .
9.6 Groupet may decide to reimburse the Member all or part of the Total Fees in accordance with the Member Refund Policy in the event that a Member suffers any setback and is unable to attend the Activity.
9.7 If a Member or Groupet cancels a reservation and the Member receives a refund in accordance with the Member Refund Policy, after the Member has already received payment, Groupet may process the refund by the Member of the amount of said refund , including the deduction of such reimbursed amount from any Charges owed to the Member.
9.8 Except as otherwise provided in these Terms, Members may use the email support@groupet.es to send or request refund money, additional Organizer Services, Co-Organizer Services or Claims for Damages related to reservations of Activities.
10. Evaluations and comments
10.1 Within a limited period of time from the completion of a reservation, Members and Organizers may leave a public review (“Review”). The Reviews reflect the views of individual Members and not the views of Groupet. Groupet does not verify the accuracy of the Reviews and Comments, which could thus be incorrect or misleading.
10.2 Ratings and Evaluations by Members and Organizers must be successful; Furthermore, they may not contain offensive or offensive language.
10.3 Members are prohibited from tampering with the Ratings and Reviews system in any way, such as instructing a third party to write a negative or positive Comment about another Member or Organizer.
10.4 Reviews are part of the Member’s public profile and may also be reflected in other parts of the Groupet Platform (such as an Announcement page), along with other pertinent information such as the number of reservations, the number of cancellations, the time of mean response and other data.
11. Disputes
11.1 As a Member, you are responsible for your own acts and omissions and also for the acts and omissions of any people you invite to the Activity, with the exception of the Organizer or Co-Organizer.
11.2 Members agree to cooperate with Groupet and assist it in good faith, and provide it with information and adopt measures requested by Groupet, within reason, in relation to any Damage Claims and other complaints or claims made by Members. The right of a Member to initiate legal actions before the Courts of Justice remains unchanged.
12. Rounding
Groupet generally allows payment of amounts payable from Members or Organizers to the smallest unit that supports each currency (i.e. euro cents and other supported currencies). Where Groupet’s payment service provider does not support payment in the smallest unit that supports a currency, Groupet may, in its sole discretion, round up or down the amounts displayed.
13. Taxes
13.1 As Organizer, you are solely responsible for determining your obligations to declare, collect, remit or include VAT and other indirect or other applicable taxes (“Taxes”) in your Ad Fees.
13.2 Tax regulations may require that we collect proper tax information from our Organizers, or that we withhold taxes from payments to our Organizers, or both. If an Organizer does not provide us with the documentation required in accordance with applicable laws (for example: taxpayer number) to satisfy our obligation (if any) to withhold Taxes from the payments made to them, we reserve the right to withhold the payments of the amount that is relevant to face the taxes that are required by law, until the matter is resolved.
13.3 Members and Organizers agree that we may request additional amounts from you in the event that the Taxes collected or transferred are insufficient to fully pay their obligations to the Tax Authority, and that their only legal recourse regarding occupancy taxes collected is that the competent tax authorities reimburse the Taxes collected by Groupet in accordance with the applicable procedures available to such authorities.
14. Prohibited activities
14.1 You are solely responsible for compliance with all and any laws, rules, regulations and tax obligations that may be applicable to your use of the Groupet Platform. And explicitly, you will not take the following actions or help or allow others to do so:

- – use the Groupet platform to promote or carry out pet fights.
- – use the Groupet platform to promote or carry out a service for the sale and / or breeding of pets.
- – use an instrument or material to punish the pet, such as electric collars, during the activity.
14.2 You acknowledge that Groupet has no general obligation to monitor the Member’s Content or to actively look for facts or circumstances that indicate illegal activity, but they have the right to review, disable access or modify the Member’s Content, to 1.- operate, protect and enhance the security of the Groupet Platform (including, without limitation, for fraud prevention, risk assessment, research and customer service purposes); 2.- ensure compliance by Members of these Terms; 3.- comply with current legislation or a judicial order or requirement or issued by law enforcement agencies and other administrative agencies or government bodies; respond to Member Content that it determines to be harmful or offensive or as otherwise provided in these Terms. Members agree to cooperate and assist Groupet in good faith, as well as provide this information and take action that Groupet may reasonably request with respect to any investigation that Groupet or one of its representatives undertakes in relation to use or abuse. of the Groupet Platform.
14.3 If you have the impression that any Member with whom you interact, whether online or in person, is acting or has acted inappropriately, such as, for example, someone 1.- who engages in offensive, violent or sexually inappropriate behavior , 2.- who you suspect has stolen from you, or 3.- adopts any other disturbing behavior, you must immediately report this person to the corresponding authorities and then to Groupet. You agree that no notification you make will oblige us to take action (other than those required by law, if applicable).
15. Period of validity and termination, suspension and other measures
15.1 This Agreement will be effective until such time as you or Groupet terminate the Agreement in accordance with this provision.
15.2 You may terminate this Agreement at any time by sending us an email. If you cancel your Groupet Account as Organizer, all confirmed reservations will be automatically canceled and the Members will be fully reimbursed for all payments made. If you cancel your Groupet Account as a Member, all confirmed reservations will be automatically canceled and any refund will depend on the terms of the cancellation policy described in the Activity.
15.3 Without prejudice to our rights specified below, Groupet may terminate this Agreement for convenience at any time with thirty (30) days’ notice sent by email to your registered email address.
15.4 Groupet may terminate this Agreement and / or prevent you from accessing the Groupet Platform, immediately and without prior notice, in the event that 1.- you have substantially breached your obligations under these Terms, the Terms of Payment , our Policies or Rules , 2.- you have violated any law, regulation or rights of third parties that apply to you, or 3.- such action is necessary to protect the personal safety or material assets of Groupet, its Members or third parties (eg, in the event of fraudulent behavior by a Member).
15.5 In addition, Groupet may adopt any measure it deems pertinent to comply with the applicable legislation or with a judicial order or requirement, issued by law enforcement agencies or other administrative agencies or a governmental body, or in the event that you have breached or violated these Terms, the Payment Terms , our Policies or Rules , any applicable laws, regulations or third party rights; you have provided inaccurate, fraudulent, obsolete or incomplete information during the registration of the Groupet Account, the process of the Announcement or later; you and / or your Ads or Organizer Services do not ever meet any of the quality or eligibility criteria; you have repeatedly received negative Ratings or Evaluations or Groupet becomes aware in any way, or has received complaints about the way you have behaved or acted; you have repeatedly canceled confirmed reservations or have not responded to reservation requests without justified reason, or such action is necessary to protect the personal safety or property of Groupet, its Members or third parties, or to prevent fraud and other illegal activities.
In the case of minor breaches, and where applicable, Groupet will notify you of any action taken and give you the opportunity to resolve the problem in a manner reasonably satisfactory to Groupet.
15.6 If we adopt any of the measures; 1.- We will be able to reimburse its Members the total amount paid for all confirmed reservations, regardless of any pre-existing cancellation policy, and 2.- You will not be entitled to any compensation for confirmed or pending reservations that are canceled.
15.7 Upon termination of this Agreement, you will not have the right to have your Groupet Account or any element of your Member Content restored. If your access or use of the Groupet Platform has been limited or if your Groupet Account has been suspended or we have terminated this Agreement, you will not be able to register a new Groupet Account or access or use the Groupet Platform through the Groupet Account of another Member.
15.8 If Groupet takes any of the measures, you can appeal the decision by contacting Customer Service .
16. Liability
Groupet is liable under the regulations for malicious acts and gross negligence committed by us or by our legal representatives. The same shall apply with respect to the assumption of guarantees or any other strict liability or in the event of a negligent injury that affects life, physical integrity or health. Groupet is responsible for any negligent breaches of basic contractual obligations that are committed by us or our legal representatives, limiting said responsibility to foreseeable damages typical of the contract. The basic contractual obligations are those of Groupet whose correct fulfillment you regularly trust and must rely on for the correct performance of the contract. Any additional liability of Groupet is excluded.
17. Compensation
To the extent permitted by current law, you agree to exempt, defend (at Groupet’s discretion), indemnify and discharge Groupet, as well as those responsible, from and against any claims, liabilities, compensation for damages and damages, losses and expenses, including, without limitation, reasonable expenses for legal and accounting advice, which arise from, or are in any way related to 1.- your breach of these Terms or of our Policies or Rules , 2.- the improper use by you of the Groupet Platform or any Groupet Services, 3.- the interaction by you with any Member, your participation in an Activity, and without limitation, any injuries, losses or compensation for damages (whether they are non-compensatory sanctions, for direct, incidental, consequential or other damages) of any kind that arise in relation to, or as a result of e Activity; as well as the infringement on your part of any laws, regulations or rights of third parties. The compensation obligation only applies if and to the extent that the claims, responsibilities, damages, losses and expenses have been caused by the culpable breach of a contractual obligation.
18. Observations
Comments and suggestions to improve the Groupet Platform are welcome and we encourage you to send them to us (“Comments”). You can send us Observations by sending us an email, through the “Contact” section of the Groupet Platform or by other means of communication. Any type of Observations you send us can be used by us for any commercial purpose and will be considered non-confidential and without ownership rights.
19. Applicable law and jurisdiction
These Terms and Conditions will be governed and interpreted in accordance with Spanish legislation.
20. General provisions
22.1 With the exception of supplements that may be formed by additional terms and conditions, policies, guidelines or regulations, these Terms constitute the entire Agreement between Groupet and you with regard to its object, and supersede any and all agreements or pacts, orally or in writing, between Groupet and you in relation to accessing and using the Groupet Platform.
22.2 There is no joint venture, cooperation, employment or agency relationship between you and Groupet as a result of this Agreement or your use of the Groupet Platform.
22.3 These Terms do not confer or intend to confer any right or remedy in favor of any person other than the parties.
22.4 If any of these Terms is deemed void or unenforceable, such provision will be deleted and will not affect the validity and effect of the other provisions.
22.5 The non-application by Groupet of any right or provision of these Terms will not constitute a waiver of said right or provision unless we acknowledge or accept it in writing. Except as expressly provided in these Terms, the exercise by any of the parties of any of its resources contemplated in these Terms will be without prejudice to its other resources contemplated in these Terms or otherwise provided by law.
22.6 You may not assign, transfer or delegate this Agreement or your rights and obligations under it without the prior written consent of Groupet. Groupet may assign, transfer or delegate this Agreement and any rights and obligations under it, at its sole discretion, giving 30 days’ notice. Your right to terminate this Agreement at any time will not be affected.
22.7 Unless otherwise indicated, any notice and other communications intended for Members, necessary or permitted pursuant to this Agreement, will take place electronically and will be delivered by Groupet by email, notification on the Groupet Platform or by message. (including SMS).
